By accessing or using StackMyMap ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

StackMyMap is a local SEO automation platform that provides tools for creating Google My Maps, Drive Stacks, Cloud Stacks, KML files, geotagged images, and review management funnels to help improve local search visibility.

3. Account Registration

To use certain features, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Subscription Plans and Payments

4.1 Billing

Subscription fees are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe.

4.2 Plan Limits

Each subscription plan has specific limits on features and usage. Exceeding these limits may require upgrading to a higher plan.

4.3 Refunds

We offer a 14-day money-back guarantee for new subscriptions. After this period, refunds are provided at our discretion.

4.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are provided for unused time.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Create fake or misleading business listings
  • Generate spam or unsolicited communications
  • Attempt to manipulate search rankings in violation of search engine guidelines
  • Interfere with or disrupt the Service
  • Access the Service through automated means without permission

6. Third-Party Services

Our Service integrates with third-party platforms including Google, Stripe, and cloud hosting providers. Your use of these integrations is subject to their respective terms of service.

You are responsible for complying with Google's Terms of Service when using features that interact with Google products (Drive, Maps, Sites).

7. Intellectual Property

7.1 Our Content

The Service and its original content, features, and functionality are owned by StackMyMap and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of content you create using our Service. By using the Service, you grant us a license to store, display, and process your content as needed to provide the Service.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

We make no guarantees regarding SEO results, search rankings, or business outcomes from using the Service.

9. Limitation of Liability

To the maximum extent permitted by law, StackMyMap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

10. Indemnification

You agree to indemnify and hold harmless StackMyMap and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration.
